Mediation in family conflict

Abstract. The article presents the results of theoretical and empirical studies of the features of the mediation process as one of the modern approaches to the management of conflict interaction of subjects and presents the functions of the mediator, the implementation of which creates special socio-psychological effects. Mediation is an organized process of interaction in which one of the participants facilitates communication between two or more adversaries who are in emotional confrontation with each other and are not able to solve the problem independently and constructively. It is shown that the sociotype of a person, including the level of mental stress and accentuation, affects the mediator’s choice of methods and ways of influencing the client in the process of mediation. The content of correctly selected methods of influence by the mediator, which contribute to the best settlement of the conflict, affecting the choice of customers cooperating strategies of behavior. The results of an empirical study performed on a sample (n = 20, 21-30 years; couples who have applied to the legal clinic of the Saratov state Academy of law). It is established that the most intense relations are demonstrated by couples where former spouses, having opposite sociotypes, choose unproductive strategies of interaction in the conflict. Mediation procedures were carried out taking into account the characteristics of the types of clients, the level of their neuropsychic tension, the appropriate type of methods of influence of the mediator on each of the clients, to optimize their chosen strategies of behavior in conflict interaction with the former spouse. The applied aspect of the problem under study can be implemented in the practice of pre-trial conflict resolution services for the conclusion of a mediation agreement on mutually beneficial terms for both warring parties.
