The individual, the society and the right during the digital epoch

Abstract. In article features of development of a society and the right in the conditions of digital transformation as a whole and information-communication boom in particular with characteristic to it the accelerated processes of updating of means, forms and ways of information transfer, growth of its volumes and numbers of carriers and, hence, a growing demand of the digital skills which have become by paramount quality of successful self-realisation are considered. In view of the increased role of the information, including in formation of knowledge, behavioural requirements, trends, images, stereotypes, the author consistently analyzes modern characteristics of movement and information use: Duplicating and export of any volumes of the information with use of various resources, purposeful and any accumulation of freely plying information of the truthful and false maintenance, a separation of the information from an initial situational and substantial context, free designing of the new information by free interpretation, falsification, «выдергивания» from a context, use of possibilities of artificial intelligence for the information analysis etc., – that allows to speak about a reality of information attacks, information persecution, information provocation, infodemic. Thus ascertaining an urgency of a problem of information security as on macro – and microlevel including owing to insufficiency of legal guarantees of realisation of the information rights of the individual, the author makes an attempt to define the most important approaches in a solution of a problem. Having come to conclusion about that, the problem of distribution of other unreliable information is solved by one legislative fastening of concept of a fake cannot be, the author considers necessary to enter new concepts that will provide plurality of legal tools and efficiency of reference of those or other phenomena and the facts in information field to number of illegal acts. The fact of that modern technologies allow to form and operate with the big files of the information without advancing technological and legal maintenance of their safety, without will of the individual and without their check on reliability, for the author is the convincing proof of vulnerability and vulnerability of the individual in virtual space. From this point of view in the greatest valuable potential, according to the author, introduction of a legal regime of the information on the Internet and a legal regime of the information in the form of databases that will allow the individual possesses not only to take doubtless advantages of modern technologies, but also to influence process of gathering, storage, distribution of the information on it.
